Not illustrated.1874 Excerpt: ... simply of papers, preparing final accounts, and work of that nature, most of which is proved here in these charges, was done by Mr. Ray, and for which he made charges, is not, strictly speaking, and cannot be called, strictly speaking, practicing law. It cannot come under the statute, even if it should be claimed that Mr. Ray was his clerk. It cannot come under that section of the statute which prohibits a clerk from practicing. Because if it is practicing law, then under our rules he must be a lawyer. A layman can do all this work; a layman can prepare a final account, and sometimes executors, who are intelligent and educated men, do that themselves; I have known many of them prepare their final accounts, and yet it will hardly be claimed that they were practicing law, or practicing before the surrogate. These, we say, are the two answers in relation to Mr. Ray's acting; that he has acted there under precisely this state of circumstances; and I remark, further, that we will show, I think, in some of these cases--I am not sure, but in some of the cases that have been mooted before the public, in our county, during this heated investigation that was had there before the election--, some of these parties who made affidavit that they never had employed this man Ray; that they have never had any thing to do with him, on looking at the final accounts, we find entries thus paid to George W. Ray, attorney and counselor at law, for services, and sworn to by the same parties that swore in affidavits they never employed him. If these men had examined their accounts, they would have remembered that fact.
